Audiovisual Media Submission to Cornell Lab of Ornithology: Terms and Conditions
Please read these terms and conditions carefully. By selecting that you agree, or by submitting audiovisual media (hereinafter the “Content”) to the Cornell Lab of Ornithology (hereafter “Cornell Lab”), you acknowledge that you agree to the following terms and conditions in addition to the eBird and Merlin Community Guidelines and Cornell Lab Terms of Use.
1. Rights and Responsibility
You retain all intellectual property rights and copyright to any Content you submit.
You represent and warrant that (a) you own or otherwise control all of the rights to the Content that you submit, or you otherwise have the right to use, reproduce, distribute, and submit such Content and grant the licenses and rights granted herein; (b) the Content is accurate and not misleading; and (c) the submission and display of your Content will not infringe upon any intellectual property, privacy, or other proprietary rights of any third party. You agree not to submit Content that violates the Cornell Lab Terms of Use.
By submitting Content, you grant to Cornell University a non-exclusive, worldwide, royalty-free and perpetual license, in all media (print, electronic, or other), to use, distribute, sublicense (see below), reproduce, modify, adapt, and publicly display the Content for any purposes that further the research and educational mission of the Cornell Lab. These purposes may include (without limitation) scientific research, display on Cornell Lab websites and applications such as eBird, Merlin, Macaulay Library, Birds of the World, promotional uses, and inclusion in Cornell Lab multimedia content and products. Whenever the Cornell Lab uses your media, you will be attributed.
Cornell Lab may sublicense the Content according to your selected external party license. If you do not select an external license, we retain the right to sublicense the Content to third parties for non-commercial use only. You agree that you are solely responsible for protecting the Content from infringement by a third party; Cornell Lab is not responsible for pursuing such claims on your behalf. Cornell Lab reserves the right (but is not obligated to) screen, hide, or remove any Content and revoke the ability to submit Content for any reason, at any time, without prior notice, at its sole discretion. Cornell Lab will have no liability or responsibility to any person or entity for the performance or nonperformance of such activities.
2. Changes
Cornell Lab reserves the right to change, modify, revise, or otherwise amend any provision to these Terms and Conditions at any time. Your continued submission of Content following the posting of any changes to this Agreement constitutes your acceptance of those changes. Any new features, tools, resources, or services offered by the Cornell Lab pertaining to the submission of Content shall also be subject to the Terms and Conditions of this Agreement.
3. Eligibility
You represent that you are 18 years old or older. If you are between the ages of 13 and 17, you may submit Content with the written consent of a parent or guardian who also agrees to these terms and conditions.
For Young Birders:
We’re thrilled you would like to contribute media to eBird! If you are between the ages of 13 and 17, please ask your parents to send us an email so you can use the media upload tools. This is important. Thank you!
For Parents and Guardians:
If you would like to grant your 13-17-year-old permission to upload their media to eBird, please send an email to eBird@cornell.edu. Please review the terms and conditions found above. Feel free to copy the text below into an email message.
“I grant my child (insert name) permission to upload media to eBird. I agree to the terms and conditions for uploading media.”
